La decisi\u00f3n fue adoptada este lunes 28 de septiembre de 2026, luego de revisar las pruebas y argumentos presentados durante el proceso judicial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">De acuerdo con la Fiscal\u00eda General de la Naci\u00f3n, las pruebas permitieron establecer el ciclo de violencia f\u00edsica, verbal y psicol\u00f3gica al que Ricci Garc\u00eda someti\u00f3 a la deportista, en un contexto marcado por los celos. Posteriormente, el condenado le caus\u00f3 la muerte con un arma de fuego en la vivienda donde resid\u00edan, ubicada sobre la v\u00eda que conduce al cerro de Cristo Rey.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tras conocer los hechos, integrantes del <strong>Cuerpo T\u00e9cnico de Investigaci\u00f3n (CTI)<\/strong> y de la Polic\u00eda Metropolitana de Cali acudieron al inmueble. En el lugar encontraron a Ricci Garc\u00eda con un arma de fuego en la mano y el cuerpo de Luz Mery Trist\u00e1n en una de las habitaciones, seg\u00fan lo establecido durante la investigaci\u00f3n.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En la decisi\u00f3n de segunda instancia, la Sala Penal tambi\u00e9n acogi\u00f3 la solicitud de la Fiscal\u00eda de retirar la condena relacionada con el delito de <strong>fabricaci\u00f3n, tr\u00e1fico, porte o tenencia de armas de fuego, accesorios, partes o municiones<\/strong>, debido a que el procesado contaba con el permiso correspondiente para portar el arma.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Como consecuencia de esta modificaci\u00f3n, el Tribunal Superior de Cali fij\u00f3 la pena en <strong>41 a\u00f1os y 5 meses de prisi\u00f3n por el feminicidio agravado<\/strong> de Luz Mery Trist\u00e1n.
