Los hechos investigados ocurrieron el pasado 3 de octubre en un hotel del municipio tolimense, y seg\u00fan el dictamen forense el ni\u00f1o muri\u00f3 por asfixia mec\u00e1nica.<\/p>\n\n\n\n<p>Esta es una sentencia hito en Colombia porque es la primera vez que se logra probar que el homicidio de un ni\u00f1o por parte de su padre, se realiza para generar dolor y sufrimiento a su expareja, lo que se denomina por la doctrina como violencia vicaria.<\/p>\n\n\n\n<p>Los elementos materiales probatorios recaudados por la Fiscal\u00eda dan cuenta de que la madre del ni\u00f1o ven\u00eda siendo sometida a un ciclo de violencia.<\/p>\n\n\n\n<p>Desde el momento en el que fue encontrado el cuerpo del menor de edad, la Fiscal\u00eda dispuso de un equipo especializado conformado por expertos en violencia de g\u00e9nero, de la Brigada de Homicidios del Cuerpo T\u00e9cnico de Investigaci\u00f3n (CTI), expertos en lofoscopia, fotograf\u00eda, topograf\u00eda e inform\u00e1tica forense del Grupo de Criminal\u00edstica de Ibagu\u00e9, entre otras especialidades.<\/p>\n\n\n\n<p>El hombre fue capturado d\u00edas despu\u00e9s y ante la contundencia del material probatorio presentado por la Fiscal\u00eda acept\u00f3 cargos en su contra.
