{"id":56260,"date":"2023-07-10T06:27:03","date_gmt":"2023-07-10T11:27:03","guid":{"rendered":"https:\/\/luchonoticias.com\/?p=56260"},"modified":"2023-07-10T06:27:04","modified_gmt":"2023-07-10T11:27:04","slug":"ley-de-garantias-2023-procuraduria-presento-las-principales-recomendaciones-en-el-periodo-de-restriccion","status":"publish","type":"post","link":"https:\/\/luchonoticias.com\/editor\/ley-de-garantias-2023-procuraduria-presento-las-principales-recomendaciones-en-el-periodo-de-restriccion\/","title":{"rendered":"Ley de Garant\u00edas 2023: Procuradur\u00eda present\u00f3 las principales recomendaciones en el periodo de restricci\u00f3n"},"content":{"rendered":"\n<p>La&nbsp;<strong>Procuradur\u00eda General de la Naci\u00f3n,&nbsp;<\/strong>dentro de la vigilancia preventiva que realiza al&nbsp;<strong>proceso electoral de 2023,&nbsp;<\/strong>present\u00f3 las recomendaciones generales para dar cumplimiento a la&nbsp;<strong>Ley de Garant\u00edas&nbsp;Electorales,<\/strong>&nbsp;especialmente, en lo relacionado con<strong>&nbsp;la prohibici\u00f3n de celebrar convenios<\/strong>&nbsp;o contratos administrativos,&nbsp;<strong>modificaci\u00f3n de plantas de personal,<\/strong>&nbsp;participaci\u00f3n en pol\u00edtica de servidores p\u00fablicos, y a la observancia del principio de la planeaci\u00f3n.<\/p>\n\n\n\n<p><strong>A trav\u00e9s de la Directiva 010<\/strong>&nbsp;destinada a gobernadores, alcaldes, secretarios, gerentes, directores y ordenadores del gasto en&nbsp;<strong>entidades descentralizadas del orden municipal,&nbsp;<\/strong>departamental y distrital, el&nbsp;<strong>ente de control<\/strong>&nbsp;invit\u00f3 a servidores p\u00fablicos para que contin\u00faen con el&nbsp;<strong>normal desarrollo durante el per\u00edodo de restricci\u00f3n,<\/strong>&nbsp;cumplan los cronogramas de actividades y la gesti\u00f3n obedezca a sus planes de desarrollo previamente aprobados.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Recomendaciones<\/strong><\/h4>\n\n\n\n<p>Como parte de las&nbsp;<em>\u201cProhibiciones a las autoridades para elecciones locales y departamentales\u201d&nbsp;<\/em>durante la&nbsp;<strong>Ley de Garant\u00edas Electorales<\/strong>&nbsp;que inici\u00f3 el&nbsp;<strong>pasado 29 de junio y culminar\u00e1 el 29 de octubre<\/strong>, la&nbsp;<strong>Procuradur\u00eda<\/strong>&nbsp;record\u00f3 que no est\u00e1 permitido&nbsp;<strong>celebrar convenios interadministrativos<\/strong>&nbsp;para ejecutar recursos; participar, promover o&nbsp;<strong>destinar recursos p\u00fablicos para reuniones de car\u00e1cter proselitistas,<\/strong>&nbsp;inaugurar obras p\u00fablicas o iniciar programas de&nbsp;<strong>car\u00e1cter social en reuniones o eventos&nbsp;<\/strong>en los que participen&nbsp;<strong>candidatos o voceros de partidos pol\u00edticos,<\/strong>&nbsp;as\u00ed como modificar las plantas de personal, entre otras.<\/p>\n\n\n\n<p>En lo que respecta a los&nbsp;<strong>servidores p\u00fablicos<\/strong>&nbsp;y quienes cumplan funciones p\u00fablicas, reiter\u00f3 la<strong>&nbsp;Directiva 07 de 2023<\/strong>, donde se especifican cu\u00e1les son las prohibiciones y conductas relacionadas con la intervenci\u00f3n en actividades de los&nbsp;<strong>partidos pol\u00edticos y en controversias pol\u00edticas.<\/strong><\/p>\n\n\n\n<p>En materia de contrataci\u00f3n, recomend\u00f3 tener en cuenta l<strong>as excepciones a las prohibiciones<\/strong>&nbsp;en materia de contrataci\u00f3n, entre estas, para cubrir&nbsp;<strong>emergencias educativas, sanitarias y desastres<\/strong>, as\u00ed como los utilizados para la reconstrucci\u00f3n de&nbsp;<strong>v\u00edas, puentes, carreteras, infraestructura energ\u00e9tica y de comunicaciones,<\/strong>&nbsp;en caso de que hayan sido objeto de atentados,&nbsp;<strong>acciones terroristas,<\/strong>&nbsp;desastres naturales o casos de fuerza mayor, as\u00ed como los que deban&nbsp;<strong>realizar las entidades sanitarias y hospitalarias.\u200b<\/strong><\/p>\n\n\n\n<p><strong>El documento tambi\u00e9n resalt\u00f3 las excepciones&nbsp;<\/strong>a la prohibici\u00f3n de vinculaci\u00f3n de la planta estatal que excluye la provisi\u00f3n de cargos por faltas definitivas<strong>&nbsp;(muerte o renuncia irrevocable al cargo debidamente aceptada).<\/strong><\/p>\n\n\n\n<p><strong>La Procuradur\u00eda<\/strong>&nbsp;record\u00f3 que los&nbsp;<strong>Comit\u00e9s Territoriales de Control Electoral&nbsp;<\/strong>solicitar\u00e1n la informaci\u00f3n que consideren necesaria e igualmente, programar\u00e1n y practicar\u00e1n las&nbsp;<strong>visitas preventivas para la vigilancia&nbsp;<\/strong>y verificaci\u00f3n del cumplimiento de las restricciones all\u00ed establecidas.
