neg\u00f3 suspender aseguramiento contra Mancuso y no aval\u00f3 que sea &#8216;Gestor de Paz&#8217;"},"content":{"rendered":"<p>El magistrado Carlos Andr\u00e9s P\u00e9rez, de la Sala de Justicia y Paz del Tribunal Superior de Barranquilla, neg\u00f3 la solicitud de suspender las 33 medidas de aseguramiento que cursan contra Salvatore Mancuso, porque consider\u00f3 que la resoluci\u00f3n que lo designa gestor de paz es inconstitucional.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00abLa Sala encuentra serios vicios de la Resoluci\u00f3n Presidencial, que obligan a su inaplicaci\u00f3n por inconstitucional, toda vez que en la pr\u00e1ctica genera un indulto\u00bb, indic\u00f3 P\u00e9rez, haciendo referencia a la designaci\u00f3n que realiz\u00f3 Presidente Gustavo Petro a Mancuso como gestor de paz.<\/p>\n<p>&nbsp;<\/p>\n<p>Adem\u00e1s, expres\u00f3 \u00abMancuso no es integrante un grupo armado al margen de la ley, por ende no puede ser beneficiario de la art\u00edculo 61 de ley 975 de 2005 (de Justicia y Paz), tampoco pueden extenderse los efectos de la norma sin que hay una aprobaci\u00f3n normativa del Congreso\u00bb.<\/p>\n<p>&nbsp;<\/p>\n<p>El magistrado record\u00f3 que las Autodefensas se desmovilizaron, por ende Mancuso actualmente no hace parte de un grupo al margen de la ley. \u00abLa suspensi\u00f3n de penas y medidas de aseguramiento en Justicia y Paz solo aplica a los miembros de grupos armados ilegales organizados al margen de la ley\u00bb, aclar\u00f3.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00abLa designaci\u00f3n del se\u00f1or Mancuso como gestor de paz no tiene l\u00edmites temporales y geogr\u00e1ficos\u00bb, recalc\u00f3 el magistrado durante la lectura del fallo, adem\u00e1s, indic\u00f3 que muchos de las pertenecientes a las AUC que se desmovilizaron,
