La multa impuesta equivale a 250 UVT, es decir, $10.603.000, y se dio tras una queja presentada en 2021 por dirigentes sindicales de la Federaci\u00f3n General de Trabajadores del Huila.<\/p>\n\n\n\n<p>La queja se fundament\u00f3 en la negativa de la entidad, bajo la gerencia de Ivanna Alejandra Quijano, para ascender a Jovel Mu\u00f1oz, quien cumple con los requisitos exigidos para ocupar el cargo vacante de profesional universitario en el \u00e1rea de tesorer\u00eda. Seg\u00fan los sindicalistas, esta omisi\u00f3n vulnera acuerdos colectivos y constituye un acto arbitrario y de abuso de autoridad.<\/p>\n\n\n\n<p>El ministerio destac\u00f3 la obligaci\u00f3n de cumplir las convenciones colectivas, las cuales tienen car\u00e1cter vinculante seg\u00fan la sentencia C-902 de 2003 de la Corte Constitucional. Adem\u00e1s, cuestion\u00f3 por qu\u00e9 la gerencia aprob\u00f3 el art\u00edculo 13 de la convenci\u00f3n para cubrir vacantes, pese a la existencia de un acuerdo previo que regulaba este asunto desde 2015.<\/p>\n\n\n\n<p>Finalmente, se evidenci\u00f3 que los responsables conoc\u00edan las normativas aplicables pero actuaron de forma negligente.
