El fallo concluy\u00f3 que, durante su campa\u00f1a de reelecci\u00f3n en 2014, Cuenca ofreci\u00f3 tejas de zinc y bultos de cemento a comunidades en Guain\u00eda a cambio de votos. Los materiales eran entregados mediante vales en comercios de In\u00edrida como \u00abLos Rivera\u00bb y \u00abEl Castillo.\u00bb<\/p>\n\n\n\n<p>La evidencia presentada por la Fiscal\u00eda incluy\u00f3 testimonios de votantes y fotograf\u00edas que mostraban a miembros de su equipo entregando los materiales. Seg\u00fan el tribunal, estas d\u00e1divas representaban un acto ilegal dirigido a garantizar su reelecci\u00f3n. La Corte tambi\u00e9n destac\u00f3 que algunas de las v\u00edctimas de esta pr\u00e1ctica eran ind\u00edgenas con dificultades en el lenguaje, pero habilitadas para votar.<\/p>\n\n\n\n<p>Aunque la condena incluye inhabilidad para ejercer funciones p\u00fablicas por 7 a\u00f1os y 8 meses y una multa superior a 360 millones de pesos, Cuenca cumplir\u00e1 la pena bajo detenci\u00f3n domiciliaria una vez el fallo sea definitivo. La Sala justific\u00f3 esta decisi\u00f3n argumentando que el congresista no representa un peligro para la sociedad ni riesgo de evasi\u00f3n.<\/p>\n\n\n\n<p>El beneficio fue otorgado al cumplir con los requisitos legales: una pena menor a ocho a\u00f1os y la ausencia de antecedentes adicionales que justifiquen reclusi\u00f3n intramural.
