Seg\u00fan esta interpretaci\u00f3n, al cumplirse un mes desde su radicaci\u00f3n, el presidente Gustavo Petro estar\u00eda facultado para emitir el decreto que convoque oficialmente a las urnas. \u201cLa consulta popular es decretable de acuerdo a la Constituci\u00f3n y la ley\u201d, afirm\u00f3 Petro en su cuenta de X, citando una columna del exfiscal Eduardo Montealegre.<\/p>\n\n\n\n<p>El ministro del Interior, Armando Benedetti, ha respaldado esta tesis, se\u00f1alando que al menos dos expresidentes de la Corte Constitucional coinciden en que Petro puede convocar la consulta por decreto, dada la supuesta \u201cinexistencia del hecho\u201d por las irregularidades en el tr\u00e1mite legislativo. Para Benedetti, los vicios del procedimiento eliminan cualquier efecto jur\u00eddico de la votaci\u00f3n del Senado.<\/p>\n\n\n\n<p>El ministro tambi\u00e9n arremeti\u00f3 contra el presidente del Senado, Efra\u00edn Cepeda, por no garantizar transparencia durante el debate. Asegura que \u201cfraudes, trampas y jugaditas\u201d impidieron que el Congreso se pronunciara leg\u00edtimamente. En medio de este contexto, Benedetti subraya que garantizar la participaci\u00f3n ciudadana es un mandato constitucional que debe defenderse, y relaciona la resistencia del Congreso con las protestas sociales actuales.<\/p>\n\n\n\n<p>Hasta ahora, no se ha expedido ning\u00fan decreto presidencial, pero seg\u00fan la postura del Gobierno, Petro tendr\u00eda hasta el final de la primera semana de junio para firmarlo.
