{"id":88964,"date":"2025-10-07T13:45:06","date_gmt":"2025-10-07T18:45:06","guid":{"rendered":"https:\/\/luchonoticias.com\/?p=88964"},"modified":"2025-10-07T13:45:10","modified_gmt":"2025-10-07T18:45:10","slug":"consulta-de-la-izquierda-de-nuevo-en-veremos","status":"publish","type":"post","link":"https:\/\/luchonoticias.com\/editor\/consulta-de-la-izquierda-de-nuevo-en-veremos\/","title":{"rendered":"Consulta de la Izquierda, de nuevo en veremos"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">El <strong>Tribunal Superior de Bogot\u00e1<\/strong> declar\u00f3 <strong>improcedente<\/strong> la tutela presentada por <strong>Diana Carolina Corcho Mej\u00eda<\/strong> y <strong>Gustavo Bol\u00edvar Moreno<\/strong> contra la resoluci\u00f3n 09673 del <strong>Consejo Nacional Electoral (CNE)<\/strong>, que otorg\u00f3 la <strong>personer\u00eda jur\u00eddica al Pacto Hist\u00f3rico<\/strong> como un solo partido para las pr\u00f3ximas elecciones, dejando por fuera a los movimientos <strong>Progresistas<\/strong> y <strong>Colombia Humana<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El pasado <strong>25 de septiembre<\/strong>, mientras se estudiaba la tutela, el Tribunal hab\u00eda accedido a una <strong>medida cautelar<\/strong> solicitada por los demandantes y <strong>suspendi\u00f3 provisionalmente<\/strong> la resoluci\u00f3n del CNE, lo que permiti\u00f3 que precandidatos de Colombia Humana se inscribieran para las listas al Congreso y la consulta interna del Pacto Hist\u00f3rico.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sin embargo, la nueva decisi\u00f3n <strong>revoca esa suspensi\u00f3n<\/strong> y <strong>ratifica la determinaci\u00f3n del CNE<\/strong>, que mantiene a Colombia Humana fuera de la fusi\u00f3n del Pacto Hist\u00f3rico. La tutela, por tanto, no surti\u00f3 efecto y la resoluci\u00f3n del \u00f3rgano electoral recupera su plena vigencia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En el fallo se establece expresamente: \u201c<strong>Negar el amparo de los derechos fundamentales a la participaci\u00f3n pol\u00edtica e igualdad invocados por los solicitantes<\/strong> (\u2026) y dejar sin efectos la medida provisional decretada el 25 de septiembre de 2025\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El Tribunal sostuvo que el condicionamiento del CNE \u201c<strong>no constituye un trato discriminatorio<\/strong>, sino una <strong>aplicaci\u00f3n razonable y uniforme<\/strong> del marco normativo previsto en la <strong>Ley 1475 de 2011<\/strong>, respaldada adem\u00e1s por los principios establecidos por la <strong>Corte Constitucional<\/strong> en la sentencia <strong>C-490 de 2011<\/strong>\u201d.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>El Tribunal Superior de Bogot\u00e1 declar\u00f3 improcedente la tutela presentada por Diana Carolina Corcho Mej\u00eda y Gustavo Bol\u00edvar Moreno contra la resoluci\u00f3n 09673 del Consejo Nacional Electoral (CNE), que otorg\u00f3 la personer\u00eda jur\u00eddica al Pacto Hist\u00f3rico como un solo partido para las pr\u00f3ximas elecciones, dejando por fuera a los movimientos Progresistas y Colombia Humana.
