{"id":90114,"date":"2025-11-08T04:15:01","date_gmt":"2025-11-08T09:15:01","guid":{"rendered":"https:\/\/luchonoticias.com\/?p=90114"},"modified":"2025-11-08T04:15:03","modified_gmt":"2025-11-08T09:15:03","slug":"estado-responsable-de-la-muerte-de-magistrado-auxiliar","status":"publish","type":"post","link":"https:\/\/luchonoticias.com\/editor\/estado-responsable-de-la-muerte-de-magistrado-auxiliar\/","title":{"rendered":"Estado, responsable de la muerte de magistrado auxiliar"},"content":{"rendered":"\n<p>El Consejo de Estado declar\u00f3 la responsabilidad patrimonial de la Naci\u00f3n por la muerte de Jorge Alberto Echeverry Correa, magistrado auxiliar de la Sala Laboral de la Corte Suprema de Justicia, ocurrida durante la toma y retoma del Palacio de Justicia en noviembre de 1985.<\/p>\n\n\n\n<p>La alta corte concluy\u00f3 que el fallecimiento del funcionario judicial se debi\u00f3 no solo a la acci\u00f3n violenta del M-19, sino tambi\u00e9n a la omisi\u00f3n del Estado en garantizar su seguridad y al uso desproporcionado de la fuerza durante la operaci\u00f3n militar de recuperaci\u00f3n del edificio.<\/p>\n\n\n\n<p>En la sentencia, que condena a la Naci\u00f3n y al Ministerio de Defensa, el Consejo de Estado afirm\u00f3 que la toma del Palacio de Justicia no puede considerarse una haza\u00f1a pol\u00edtica ni un acto heroico, sino \u201cla afrenta m\u00e1s grave al Estado de derecho desde la fundaci\u00f3n de la Rep\u00fablica\u201d y una amenaza directa contra la institucionalidad y la justicia.<\/p>\n\n\n\n<p>Adem\u00e1s de ordenar el pago de perjuicios morales y lucro cesante a los familiares del magistrado Echeverry, la corporaci\u00f3n dispuso que el fallo sea publicado en un medio de amplia circulaci\u00f3n y que se realice un acto p\u00fablico de perd\u00f3n en memoria de la v\u00edctima.<\/p>\n\n\n\n<p>El Consejo de Estado tambi\u00e9n exhort\u00f3 al Ministerio de Defensa a iniciar una acci\u00f3n de repetici\u00f3n contra el M-19 o sus m\u00e1ximos comandantes, con el fin de que asuman la responsabilidad correspondiente por la tragedia del Palacio de Justicia y la muerte del magistrado auxiliar.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>El Consejo de Estado declar\u00f3 la responsabilidad patrimonial de la Naci\u00f3n por la muerte de Jorge Alberto Echeverry Correa, magistrado auxiliar de la Sala Laboral de la Corte Suprema de Justicia, ocurrida durante la toma y retoma del Palacio de Justicia en noviembre de 1985.
