En un reciente fallo de tutela, el alto tribunal record\u00f3 que la familia debe ser el primer espacio de acogida, inclusi\u00f3n y protecci\u00f3n para todos sus integrantes, sin distinci\u00f3n.<\/p>\n\n\n\n<p>La decisi\u00f3n se origin\u00f3 en el caso de <strong>Fabiola<\/strong>, una mujer transg\u00e9nero que denunci\u00f3 ante la Corte haber sido v\u00edctima de discriminaci\u00f3n por parte de una <strong>comisar\u00eda de familia<\/strong>, en medio de un proceso de violencia intrafamiliar promovido por su madre y hermanos.<\/p>\n\n\n\n<p>El alto tribunal concluy\u00f3 que la comisar\u00eda vulner\u00f3 los derechos fundamentales de Fabiola a la <strong>dignidad humana, igualdad, libre desarrollo de la personalidad, identidad de g\u00e9nero, debido proceso y vivienda digna<\/strong>, al no aplicar un enfoque de g\u00e9nero ni los enfoques diferenciales requeridos para atender su situaci\u00f3n.<\/p>\n\n\n\n<p>En su an\u00e1lisis, la Corte enfatiz\u00f3 que la familia debe ser un espacio donde cada integrante tenga la posibilidad de \u201c<strong>ser, pertenecer y sanar<\/strong>\u201d, y destac\u00f3 la importancia de reconocer la <strong>otredad<\/strong>, entendida como la aceptaci\u00f3n del otro como un sujeto aut\u00f3nomo, diverso y valioso. Tambi\u00e9n advirti\u00f3 que las personas trans suelen enfrentar entornos sociales marcados por la exclusi\u00f3n y la violencia.<\/p>\n\n\n\n<p>El fallo incluy\u00f3 un <strong>salvamento de voto<\/strong> del magistrado <strong>Jorge Enrique Ib\u00e1\u00f1ez<\/strong>, quien, aunque respald\u00f3 el enfoque interseccional, expres\u00f3 reparos sobre la valoraci\u00f3n de las pruebas.
