{"id":90962,"date":"2025-12-03T14:38:37","date_gmt":"2025-12-03T19:38:37","guid":{"rendered":"https:\/\/luchonoticias.com\/?p=90962"},"modified":"2025-12-03T14:38:38","modified_gmt":"2025-12-03T19:38:38","slug":"presentado-proyecto-de-ley-contra-en-fentanilo","status":"publish","type":"post","link":"https:\/\/luchonoticias.com\/editor\/presentado-proyecto-de-ley-contra-en-fentanilo\/","title":{"rendered":"Presentado proyecto de ley contra en fentanilo"},"content":{"rendered":"\n<p>El Gobierno nacional present\u00f3 ante el <strong>Congreso de la Rep\u00fablica<\/strong> el proyecto de ley \u201cpor medio del cual se penaliza de manera aut\u00f3noma el tr\u00e1fico, la fabricaci\u00f3n, el desv\u00edo y el porte ilegal de fentanilo y sus an\u00e1logos\u201d, una iniciativa que incorpora un nuevo delito en el <strong>C\u00f3digo Penal<\/strong> y fortalece la capacidad del Estado para anticiparse a la expansi\u00f3n de esta sustancia en el pa\u00eds.<\/p>\n\n\n\n<p>Durante la radicaci\u00f3n, el ministro del Interior, <strong>Armando Benedetti<\/strong>, explic\u00f3 que el proyecto tiene un <strong>enfoque preventivo y de control temprano<\/strong> frente al fen\u00f3meno del fentanilo. \u201cBuscamos impedir que los laboratorios de fentanilo que operan en otros pa\u00edses lleguen a Colombia. Todo lo relacionado con su fabricaci\u00f3n, transporte, desv\u00edo, distribuci\u00f3n o exportaci\u00f3n ser\u00e1 penalizado con penas de 10 a 30 a\u00f1os\u201d, afirm\u00f3.<\/p>\n\n\n\n<p>La iniciativa crea el art\u00edculo <strong>376A del C\u00f3digo Penal<\/strong>, con penas de <strong>140 a 360 meses de prisi\u00f3n<\/strong> y multas entre <strong>1.334 y 50.000 salarios m\u00ednimos legales<\/strong> para quienes, sin autorizaci\u00f3n, introduzcan, saquen, transporten, almacenen, financien, elaboren o suministren fentanilo. Adem\u00e1s, fortalece los mecanismos de <strong>prevenci\u00f3n, vigilancia sanitaria y pedagog\u00eda p\u00fablica<\/strong>.<\/p>\n\n\n\n<p>Por su parte, el ministro de Justicia, <strong>Andr\u00e9s Id\u00e1rraga<\/strong>, se\u00f1al\u00f3 que el proyecto establece un <strong>tipo penal espec\u00edfico<\/strong>, con agravantes y exclusi\u00f3n de beneficios penales, que mejora la capacidad de judicializaci\u00f3n, desincentiva el mercado il\u00edcito y promueve la <strong>cero tolerancia frente al desv\u00edo de fentanilo desde el sector salud y entornos vulnerables<\/strong>.<\/p>\n\n\n\n<p>La iniciativa tambi\u00e9n refuerza la <strong>vigilancia de la cadena de suministro<\/strong>, asigna responsabilidades claras a entidades como el <strong>Ministerio de Salud y la Superintendencia de Salud<\/strong>, y fortalece las sanciones para profesionales que utilicen fentanilo fuera de la norma. Seg\u00fan el ministro Benedetti, es una <strong>respuesta integral<\/strong>, basada en experiencias internacionales, que protege la <strong>salud p\u00fablica y la seguridad del
