{"id":91278,"date":"2025-12-12T14:09:59","date_gmt":"2025-12-12T19:09:59","guid":{"rendered":"https:\/\/luchonoticias.com\/?p=91278"},"modified":"2025-12-12T14:10:00","modified_gmt":"2025-12-12T19:10:00","slug":"corte-constitucional-protege-a-petro","status":"publish","type":"post","link":"https:\/\/luchonoticias.com\/editor\/corte-constitucional-protege-a-petro\/","title":{"rendered":"Corte Constitucional protege a Petro"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">La <strong>Corte Constitucional<\/strong> public\u00f3 en su totalidad la sentencia del caso entre el <strong>presidente Gustavo Petro<\/strong> y el <strong>Consejo Nacional Electoral (CNE)<\/strong> por presuntas irregularidades en la financiaci\u00f3n de la campa\u00f1a presidencial de 2022. El alto tribunal reafirm\u00f3 la vigencia del <strong>fuero presidencial<\/strong> y utiliz\u00f3 como referencia el caso <strong>Trump vs. Estados Unidos<\/strong>, marcando as\u00ed un precedente jur\u00eddico en Colombia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En mayo de este a\u00f1o, la Corte hab\u00eda frenado una eventual sanci\u00f3n del CNE contra el mandatario, luego de una pol\u00e9mica decisi\u00f3n del <strong>Consejo de Estado<\/strong> que hab\u00eda avalado la competencia de ese organismo para investigarlo. En ese momento solo se conoc\u00eda el resolutivo de la sentencia; sin embargo, ahora se revelaron los fundamentos jur\u00eddicos completos.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El tribunal colombiano cit\u00f3 el precedente estadounidense para explicar el alcance de la inmunidad presidencial. \u201cLa Corte estadounidense desarroll\u00f3 espec\u00edficamente el alcance de la inmunidad penal, se\u00f1alando que busca evitar que la amenaza de sanciones penales distorsione el ejercicio independiente del poder presidencial\u201d, indica el fallo, adoptando esa interpretaci\u00f3n para el contexto colombiano.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En su an\u00e1lisis, la <strong>Corte Constitucional<\/strong> fue enf\u00e1tica en dos puntos principales. Primero, reiter\u00f3 que <strong>el CNE no puede investigar ni sancionar a un presidente en ejercicio<\/strong> por asuntos de financiaci\u00f3n de campa\u00f1a, pues esa competencia recae exclusivamente en el <strong>Congreso de la Rep\u00fablica<\/strong>, a trav\u00e9s de la <strong>Comisi\u00f3n de Acusaciones de la C\u00e1mara de Representantes<\/strong> y del <strong>Senado<\/strong>. Por tanto, el presidente no puede ser tratado como \u201cun candidato m\u00e1s\u201d en materia administrativa, ya que una sanci\u00f3n de ese tipo podr\u00eda afectar su estabilidad institucional.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Segundo, la Corte determin\u00f3 que el <strong>Consejo Nacional Electoral nunca tuvo competencia<\/strong> para adelantar una investigaci\u00f3n contra Petro. De esta manera, corrigi\u00f3 el criterio del Consejo de Estado, restableci\u00f3 el fuero presidencial y orden\u00f3 trasladar todo el caso a la <strong>Comisi\u00f3n de Acusaciones<\/strong>, \u00f3rgano encargado de conocer eventuales faltas del jefe de Estado.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Actualmente, la defensa del presidente interpuso una <strong>denuncia por prevaricato<\/strong> ante dicha Comisi\u00f3n contra los magistrados del CNE y los miembros de la Sala de Consulta del Consejo de Estado que habilitaron el proceso.
