La acci\u00f3n fue presentada en representaci\u00f3n del comerciante <strong>Alexander Donato Rond\u00f3n<\/strong> y dirigida contra la <strong>Presidencia de la Rep\u00fablica<\/strong> y los <strong>ministerios de Hacienda y Trabajo<\/strong>.<\/p>\n\n\n\n<p>Seg\u00fan el exmagistrado, el decreto vulnera el <strong>derecho fundamental al debido proceso<\/strong> y desconoce el <strong>principio de concertaci\u00f3n tripartita<\/strong>, ya que \u2014afirma\u2014 fue expedido <strong>sin di\u00e1logo<\/strong> entre el Gobierno Nacional, los empresarios y los trabajadores. Linares argumenta que la medida se adopt\u00f3 de forma unilateral, sin el consenso previsto en la ley laboral.<\/p>\n\n\n\n<p>La <strong>tutela contra el aumento del salario m\u00ednimo 2026<\/strong> tambi\u00e9n cuestiona el incremento del <strong>24,5% en el auxilio de transporte<\/strong>, que en conjunto representa un alza promedio del <strong>23,7%<\/strong>. Para Linares, el Ejecutivo se bas\u00f3 en un criterio \u201c<strong>extralegal<\/strong>\u201d denominado \u201c<strong>salario vital<\/strong>\u201d, inspirado en un estudio de la <strong>Organizaci\u00f3n Internacional del Trabajo (OIT)<\/strong>, sin el respaldo formal de la Comisi\u00f3n de Concertaci\u00f3n.<\/p>\n\n\n\n<p>Adem\u00e1s, el exmagistrado solicit\u00f3 como <strong>medida provisional<\/strong> la <strong>suspensi\u00f3n temporal del decreto<\/strong> y sus efectos, al considerar que el aumento podr\u00eda causar un <strong>perjuicio irremediable<\/strong>.
