{"id":93045,"date":"2026-01-29T20:42:06","date_gmt":"2026-01-30T01:42:06","guid":{"rendered":"https:\/\/luchonoticias.com\/editor\/?p=93045"},"modified":"2026-01-29T20:42:06","modified_gmt":"2026-01-30T01:42:06","slug":"suspendido-decreto-de-emergencia-economica","status":"publish","type":"post","link":"https:\/\/luchonoticias.com\/editor\/suspendido-decreto-de-emergencia-economica\/","title":{"rendered":"Suspendido decreto de emergencia econ\u00f3mica"},"content":{"rendered":"\n<p>La Sala Plena de la Corte Constitucional orden\u00f3 la suspensi\u00f3n provisional del decreto con el que el presidente Gustavo Petro declar\u00f3 la emergencia econ\u00f3mica y social en todo el pa\u00eds.<\/p>\n\n\n\n<p>La decisi\u00f3n, basada en la ponencia del magistrado Carlos Camargo, fue aprobada con seis votos a favor y dos en contra. El alto tribunal consider\u00f3 que la medida era necesaria para evitar posibles da\u00f1os irreparables mientras se realiza el control constitucional de fondo.<\/p>\n\n\n\n<p>El decreto legislativo 1390 del 22 de diciembre de 2025 queda as\u00ed suspendido hasta que la Corte emita una decisi\u00f3n definitiva. La sala estuvo integrada por ocho magistrados, debido al impedimento aceptado del presidente del tribunal, Jorge Enrique Ib\u00e1\u00f1ez.<\/p>\n\n\n\n<p>En una ponencia de 86 p\u00e1ginas, Camargo argument\u00f3 que el decreto presenta vicios formales y materiales que justifican una medida cautelar excepcional. Seg\u00fan el magistrado, la norma carece de una motivaci\u00f3n suficiente frente a las ocho causas invocadas por el Gobierno y presenta irregularidades en su firma.<\/p>\n\n\n\n<p>Uno de los puntos m\u00e1s sensibles se\u00f1alados por Camargo es que el decreto habr\u00eda sido usado como v\u00eda para introducir reformas fiscales o tributarias sin el debate democr\u00e1tico en el Congreso, lo que \u2014advirti\u00f3\u2014 vulnerar\u00eda principios esenciales de la Constituci\u00f3n.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Sala Plena de la Corte Constitucional orden\u00f3 la suspensi\u00f3n provisional del decreto con el que el presidente Gustavo Petro declar\u00f3 la emergencia econ\u00f3mica y social en todo el pa\u00eds.
