{"id":93846,"date":"2026-02-13T10:50:46","date_gmt":"2026-02-13T15:50:46","guid":{"rendered":"https:\/\/luchonoticias.com\/editor\/?p=93846"},"modified":"2026-02-13T10:50:47","modified_gmt":"2026-02-13T15:50:47","slug":"el-paso-para-destrabar-lo-del-salario-minimo","status":"publish","type":"post","link":"https:\/\/luchonoticias.com\/editor\/el-paso-para-destrabar-lo-del-salario-minimo\/","title":{"rendered":"El paso para destrabar lo del salario m\u00ednimo"},"content":{"rendered":"\n<p>El <strong>Consejo de Estado<\/strong> anunci\u00f3 la suspensi\u00f3n provisional del decreto que estableci\u00f3 el aumento del salario m\u00ednimo para 2026, decisi\u00f3n que deja sin efectos, por ahora, el incremento decretado por el Gobierno Nacional a finales del a\u00f1o pasado.<\/p>\n\n\n\n<p>El pasado 29 de diciembre, el presidente <strong>Gustavo Petro<\/strong> hab\u00eda fijado mediante decreto el denominado \u201csalario m\u00ednimo vital\u201d en <strong>$1.750.905<\/strong>, m\u00e1s el auxilio de transporte, para un total de <strong>$2.000.000<\/strong>. Sin embargo, la medida judicial obliga al Ejecutivo a expedir un nuevo decreto en un plazo m\u00e1ximo de ocho d\u00edas calendario.<\/p>\n\n\n\n<p>De acuerdo con el fallo, \u201ca t\u00edtulo de medida cautelar, se ordena a las entidades demandadas que, dentro de los ocho d\u00edas calendario siguientes a la notificaci\u00f3n de esta providencia, expidan y publiquen un decreto en el que se fije un porcentaje transitorio de aumento del salario m\u00ednimo legal para el a\u00f1o 2026\u201d. Es decir, el nuevo valor deber\u00e1 definirse a m\u00e1s tardar el <strong>s\u00e1bado 21 de febrero<\/strong>.<\/p>\n\n\n\n<p>El alto tribunal tambi\u00e9n precis\u00f3 que el Gobierno deber\u00e1 fundamentar su decisi\u00f3n con base en los criterios econ\u00f3micos y constitucionales establecidos en la <strong>Ley 278 de 1996<\/strong>, entre ellos la <strong>meta de inflaci\u00f3n del Banco de la Rep\u00fablica<\/strong>, la <strong>productividad certificada por el Departamento Administrativo Nacional de Estad\u00edstica (DANE)<\/strong>, el crecimiento del <strong>Producto Interno Bruto (PIB)<\/strong>, la <strong>inflaci\u00f3n real<\/strong> del a\u00f1o 2025 y la <strong>contribuci\u00f3n de los salarios al ingreso nacional<\/strong>.<\/p>\n\n\n\n<p>Asimismo, el fallo resalta la importancia de mantener una remuneraci\u00f3n <strong>m\u00ednima, vital y m\u00f3vil<\/strong>, en consonancia con la <strong>protecci\u00f3n del trabajo<\/strong>, la <strong>funci\u00f3n social de la empresa<\/strong> y los <strong>principios constitucionales<\/strong> que orientan la direcci\u00f3n econ\u00f3mica del Estado.<\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>El Consejo de Estado anunci\u00f3 la suspensi\u00f3n provisional del decreto que estableci\u00f3 el aumento del salario m\u00ednimo para 2026, decisi\u00f3n que deja sin efectos, por ahora, el incremento decretado por el Gobierno Nacional a finales del a\u00f1o pasado.
