{"id":95537,"date":"2026-03-20T04:03:43","date_gmt":"2026-03-20T09:03:43","guid":{"rendered":"https:\/\/luchonoticias.com\/editor\/?p=95537"},"modified":"2026-03-20T04:03:44","modified_gmt":"2026-03-20T09:03:44","slug":"se-mantiene-eleccion-de-gregorio-eljach-como-procurador","status":"publish","type":"post","link":"https:\/\/luchonoticias.com\/editor\/se-mantiene-eleccion-de-gregorio-eljach-como-procurador\/","title":{"rendered":"Se mantiene elecci\u00f3n de Gregorio Eljach como procurador"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">La Secci\u00f3n Quinta del Consejo de Estado neg\u00f3 las demandas que pretend\u00edan anular la elecci\u00f3n de Juan Gregorio Eljach Pacheco como procurador general de la Naci\u00f3n para el periodo 2025-2029.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Durante el an\u00e1lisis, la Sala revis\u00f3 los principales cuestionamientos contra su designaci\u00f3n, entre ellos el se\u00f1alamiento de que no pod\u00eda ser postulado mientras ejerc\u00eda como secretario general del Senado.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tambi\u00e9n se aleg\u00f3 que Eljach no cumpl\u00eda con la experiencia exigida y que el presidente Gustavo Petro habr\u00eda desconocido una invitaci\u00f3n p\u00fablica del Departamento Administrativo de la Presidencia de la Rep\u00fablica al incluir en la terna a un candidato que no particip\u00f3 en ese proceso. Asimismo, se cuestion\u00f3 que la terna estuviera conformada \u00fanicamente por hombres.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No obstante, el alto tribunal concluy\u00f3 que no exist\u00eda la inhabilidad invocada, ya que las restricciones aplican a cargos de elecci\u00f3n popular y no a este tipo de designaciones. Adem\u00e1s, determin\u00f3 que el procurador cumple con el requisito de experiencia, al acreditar m\u00e1s de 15 a\u00f1os en el ejercicio jur\u00eddico.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Finalmente, el Consejo de Estado descart\u00f3 irregularidades en el proceso, se\u00f1alando que no se vulner\u00f3 el debido proceso ni el principio de separaci\u00f3n de poderes.
