{"id":96984,"date":"2026-04-20T10:57:41","date_gmt":"2026-04-20T15:57:41","guid":{"rendered":"https:\/\/luchonoticias.com\/editor\/?p=96984"},"modified":"2026-04-20T10:57:42","modified_gmt":"2026-04-20T15:57:42","slug":"asi-sera-la-entrega-de-dinero-por-el-decreto-de-emergencia-economica","status":"publish","type":"post","link":"https:\/\/luchonoticias.com\/editor\/asi-sera-la-entrega-de-dinero-por-el-decreto-de-emergencia-economica\/","title":{"rendered":"As\u00ed ser\u00e1 la entrega de dinero por el decreto de emergencia econ\u00f3mica"},"content":{"rendered":"\n<p>La Corte Constitucional de Colombia declar\u00f3 inexequible la emergencia econ\u00f3mica decretada en diciembre pasado, una decisi\u00f3n que impacta las finanzas del Gobierno nacional.<\/p>\n\n\n\n<p>Tras el fallo, el director de la DIAN, Carlos Emilio Betancourt, explic\u00f3 que el decreto tributario estuvo vigente entre el 1.\u00ba y el 29 de enero, periodo en el que se alcanzaron a recaudar cerca de 1,6 billones de pesos. La mayor parte de estos recursos correspondi\u00f3 a alivios tributarios que, seg\u00fan indic\u00f3, no deber\u00e1n ser devueltos debido a que se consideran situaciones jur\u00eddicas consolidadas.<\/p>\n\n\n\n<p>En ese contexto, precis\u00f3 que el monto que deber\u00e1 reintegrarse es cercano a los 57.000 millones de pesos.<\/p>\n\n\n\n<p>Del total recaudado, unos 24.000 millones de pesos provinieron del impuesto aplicado a la primera venta o exportaci\u00f3n de hidrocarburos y carb\u00f3n, en casos que afectaban a contribuyentes con contratos de estabilidad jur\u00eddica. Sobre este punto, el funcionario se\u00f1al\u00f3 que dichos recursos ser\u00e1n devueltos, previa solicitud de los contribuyentes que cumplan con los requisitos establecidos, como la presentaci\u00f3n de documentos de exportaci\u00f3n y facturaci\u00f3n.<\/p>\n\n\n\n<p>En cuanto al IVA aplicado a la importaci\u00f3n de licores, indic\u00f3 que no habr\u00e1 devoluci\u00f3n, ya que este impuesto es descontable en su totalidad al momento de declarar y comercializar los productos en el pa\u00eds.<\/p>\n\n\n\n<p>Para los casos relacionados con IVA en licores nacionales, juegos de suerte y azar y otras operaciones, el proceso de devoluci\u00f3n variar\u00e1 seg\u00fan la situaci\u00f3n del contribuyente. Quienes declaran impuestos podr\u00e1n realizar ajustes en sus declaraciones, mientras que las personas no declarantes deber\u00e1n inscribirse en el RUT y presentar la respectiva solicitud ante la DIAN.<\/p>\n\n\n\n<p>Respecto a las compras de bajo monto realizadas a trav\u00e9s de plataformas digitales, se deber\u00e1 validar la informaci\u00f3n de las operaciones y gestionar la devoluci\u00f3n a trav\u00e9s de los operadores log\u00edsticos, quienes posteriormente recibir\u00e1n los recursos por parte de la entidad tributaria.<\/p>\n\n\n\n<p>En t\u00e9rminos generales, las devoluciones aplicar\u00e1n principalmente a impuestos relacionados con exportaciones de hidrocarburos, algunos casos de IVA en licores y apuestas en l\u00ednea, as\u00ed como en compras internacionales de bajo valor.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Corte Constitucional de Colombia declar\u00f3 inexequible la emergencia econ\u00f3mica decretada en diciembre pasado, una decisi\u00f3n que impacta las finanzas del Gobierno nacional.
