La decisi\u00f3n fue adoptada con apoyo de conjueces y una votaci\u00f3n de 6-3, al resolver los recursos presentados contra el fallo de primera instancia.<\/p>\n\n\n\n<p>En la decisi\u00f3n inicial, cuyos ponentes fueron los magistrados \u00c1lvaro Hern\u00e1n Prada y Benjam\u00edn Ortiz, se estableci\u00f3 que la campa\u00f1a super\u00f3 los l\u00edmites legales en cerca de 3.500 millones de pesos. El caso marca un precedente, al ser la primera vez que la autoridad electoral sanciona una campa\u00f1a presidencial por irregularidades en su financiaci\u00f3n.<\/p>\n\n\n\n<p>El fallo ratifica la imposici\u00f3n de multas a los responsables del manejo financiero de la campa\u00f1a, entre ellos su entonces gerente, Ricardo Roa. Junto a \u00e9l, tambi\u00e9n deber\u00e1n responder la tesorera y la auditora por montos relacionados con financiaci\u00f3n indebida y exceso en los topes tanto en primera como en segunda vuelta.<\/p>\n\n\n\n<p>Asimismo, las colectividades Colombia Humana y Uni\u00f3n Patri\u00f3tica, que respaldaron la candidatura, fueron sancionadas con una multa de 1.100 millones de pesos cada una. No obstante, sectores del Pacto Hist\u00f3rico han se\u00f1alado que a\u00fan cuentan con la posibilidad de acudir al Consejo de Estado para apelar la decisi\u00f3n.<\/p>\n\n\n\n<p>En cuanto a eventuales consecuencias para el presidente, el Consejo de Estado determin\u00f3 que el CNE tiene competencia para adelantar investigaciones administrativas sobre la financiaci\u00f3n de campa\u00f1as.
